As we survive life’s challenges, we come face-to-face with fear and uncertainty. 

Challenges may allow us to step out of our comfort zone and push ourselves above and beyond our own self-limitations. It is how we choose to overcome challenges that make us who we are in life. It is our strength in times of difficulty that prove our character and self worth.

As I share my experience of being on a reality show, I encourage you to think about how you decide to survive on a daily basis. Also, I will encourage you to think about six words to develop your survival skills. With my six simple words, you can take on any challenge with which you are faced.

Adversity is not so much contending with problems as it is learning more about who you really are and what is inside of you.

While not every compliance or communications glitch runs the risk of litigation, in today’s litigious society many of those risks will end up in court.  And winning a lawsuit is almost as bad – in time, expense, inconvenience, and distraction from the business of the credit union – as losing one.  This session will examine litigation trends in the credit union space with a focus on how to avoid problems (if avoidable) before they head to the courtroom.

Executive Track - Fair Lending for CU’s Approaching $10B

Regulators continue to focus on fair lending and the Department of Justice (“DOJ”)’s Combatting Redlining Initiative is well underway with 10 enforcement actions to date, and dozens more under review. As credit unions grow closer to $10 billion in assets, it is important that management’s fair lending strategy keeps pace. This session will discuss what an effective fair lending program includes and the types of analysis needed to ensure you fully understand and manage your fair lending risk.

Compliance Track - You’ve Been Served, Now What?

Do you have to answer that subpoena or garnishment?    The answer is clearly…..maybe!  Almost every privacy law, rule and regulation require us to protect our members’ assets and financial data, but there are specific exceptions.  If you know where to look, there are very specific rules governing your response to valid requests and even your ability to seek recovery of expenses.  Your credit union needs to be prepared and understand what to do when you receive a legal request requiring you to hand over a member’s funds or personal information. Understanding the rules and avoiding common landmines will help reduce the risk and potential liability of an improper response.
